{"id":2324,"date":"2024-09-09T15:59:35","date_gmt":"2024-09-09T18:59:35","guid":{"rendered":"https:\/\/granda.com.br\/receita-federal-amplia-relacao-de-incentivos-renuncias-beneficios-e-imunidades-a-serem-apresentados-na-dirbi\/"},"modified":"2024-09-09T16:02:36","modified_gmt":"2024-09-09T19:02:36","slug":"receita-federal-incentivos-beneficios-dirbi-instrucao-normativa-2216-2024","status":"publish","type":"post","link":"https:\/\/granda.com.br\/en\/receita-federal-incentivos-beneficios-dirbi-instrucao-normativa-2216-2024\/","title":{"rendered":"Receita Federal amplia rela\u00e7\u00e3o de incentivos, ren\u00fancias, benef\u00edcios e imunidades a serem apresentados na DIRBI"},"content":{"rendered":"<p>Foi publicada a Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.216\/2024, que substitui o Anexo \u00danico da Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.198\/2024, que cont\u00e9m a rela\u00e7\u00e3o de incentivos, ren\u00fancias, benef\u00edcios e imunidades a serem monitorados pela Declara\u00e7\u00e3o de Incentivos, Ren\u00fancias, Benef\u00edcios e Imunidades de Natureza Tribut\u00e1ria \u2013 DIRBI.<\/p>\n<p>Conforme noticiado em nosso informativo anterior (<a href=\"https:\/\/granda.com.br\/nova-obrigacao-acessoria-para-contribuintes-que-usufruem-de-beneficios-fiscais\/\">clique aqui<\/a>), a Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.216\/2024 previa uma lista de 16 itens, em sua maioria, regimes de cr\u00e9ditos presumidos em insumos ou entradas que n\u00e3o constavam da EFD ou da ECD das empresas.<\/p>\n<p>Contudo, ap\u00f3s a altera\u00e7\u00e3o, foram acrescidos 26 itens ao controle da Receita Federal, dentre eles, o REIQ, SUDAM\/SUDENE, adubos e fertilizantes, defensivos agropecu\u00e1rios, Zona Franca de Manaus, produtos farmac\u00eauticos e qu\u00edmicos, subven\u00e7\u00f5es para investimento e inova\u00e7\u00e3o tecnol\u00f3gica.<\/p>\n<p>As informa\u00e7\u00f5es quanto aos itens inclu\u00eddos (itens 17 a 43 do Anexo \u00danico, com reda\u00e7\u00e3o da IN RFB n\u00ba 2.216\/2024), relativamente aos per\u00edodos de apura\u00e7\u00e3o de janeiro a agosto de 2024, dever\u00e3o ser apresentadas ou retificadas, conforme o caso, at\u00e9 o dia 20 de outubro de 2024.<\/p>\n<p>Para os demais meses, a declara\u00e7\u00e3o dever\u00e1 ser transmitida, de forma centralizada, pelo estabelecimento matriz, at\u00e9 o vig\u00e9simo dia do segundo m\u00eas subsequente ao do per\u00edodo de apura\u00e7\u00e3o, por exemplo: per\u00edodo de apura\u00e7\u00e3o: 10\/2024; prazo m\u00e1ximo para entrega: 20\/12\/2024.<\/p>\n<p>A aus\u00eancia ou atraso no envio ensejar\u00e1 a aplica\u00e7\u00e3o de penalidades, calculadas por m\u00eas ou fra\u00e7\u00e3o, incidentes sobre a receita bruta, limitadas a 30% do valor do programa ou benef\u00edcio usufru\u00eddo, conforme abaixo:<\/p>\n<p><strong>I.<\/strong> 0,5% sobre a receita bruta de at\u00e9 R$ 1.000.000,00;<\/p>\n<p><strong>II.<\/strong> 1% sobre a receita bruta de R$ 1.000.000,01 at\u00e9 R$ 10.000.000,00;<\/p>\n<p><strong>III.<\/strong> 1,5% sobre a receita bruta acima de R$ 10.000.000,00.<\/p>\n<p>Por fim, considerando que os valores constantes da DIRBI s\u00e3o objeto de auditoria, al\u00e9m da penalidade acima, havendo informa\u00e7\u00e3o prestada de forma equivocada, haver\u00e1 aplica\u00e7\u00e3o de multa de 3% sobre o valor omitido, inexato ou incorreto.<\/p>\n<p>O nosso time tribut\u00e1rio est\u00e1 \u00e0 disposi\u00e7\u00e3o para esclarecimentos e alinhamento de estrat\u00e9gias sobre o tema.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Foi publicada a Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.216\/2024, que substitui o Anexo \u00danico da Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.198\/2024, que cont\u00e9m a rela\u00e7\u00e3o de incentivos, ren\u00fancias, benef\u00edcios e imunidades a<span class=\"excerpt-hellip\"> [\u2026]<\/span><\/p>\n","protected":false},"author":4,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[42],"tags":[],"ppma_author":[289,290,291],"class_list":["post-2324","post","type-post","status-publish","format-standard","hentry","category-noticias-en"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Receita Federal amplia rela\u00e7\u00e3o de incentivos, ren\u00fancias, benef\u00edcios e imunidades a serem apresentados na DIRBI | Granda Advogados<\/title>\n<meta name=\"description\" content=\"Receita Federal amplia lista de incentivos e benef\u00edcios tribut\u00e1rios na DIRBI com a Instru\u00e7\u00e3o Normativa RFB n\u00ba 2.216\/2024.
